Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of Aluminium Window Design 3D and its related services (collectively, the "Service"), operated by Equitysoft Technologies Pvt. Ltd. ("we," "us," or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree with these Terms, please do not use the Service.

1. About the Service

Aluminium Window Design 3D is a mobile design and work management application intended for aluminium and uPVC window and door design, measurement, drawing, configuration, 3D visualization, and order management.

The Service may include:

• Aluminium and uPVC window and door design
• Frame shape and dimension configuration
• Window and door drawing tools
• Mullion and light division configuration
• Sash and opening configuration
• Glass, panel, screen, and other fill configuration
• Hardware and hinge configuration
• Grille and bar pattern configuration
• Frame colour and finish selection
• Drawing annotations and guidelines
• Measurement and dimension information
• 3D drawing preview
• Drawing saving and management
• Customer order management
• Customer and site information management
• Order status management
• Drawing and order association
• Offline data storage
• Synchronization of saved information when connectivity is available

Features may change, be added, or be removed over time.

2. Eligibility

You must be legally permitted to use the Service under the laws applicable to you.

By creating an account or using the Service, you confirm that the information you provide is accurate and that you meet the applicable age requirements for using the Service.

3. Account Registration

The Service requires an account to access certain features.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• Keeping your password secure
• Providing accurate account information
• All activities performed through your account
• Informing us if you suspect unauthorized access

You must not share your account credentials in a manner that compromises account security.

Authentication for the Service is handled through our backend authentication system using email and password authentication.

4. Customer and Order Information

The Service allows you to create and manage customer orders. You may enter information including:

• Customer name
• Customer phone number
• Site address
• Job total
• Currency
• Order status
• Notes
• Other information necessary to manage an order

You are responsible for ensuring that the information you enter is accurate and that you have the appropriate right or permission to use any personal information you provide.

The Service does not independently verify the accuracy of customer, site, quotation, or order information entered by users.

5. Drawings and Design Information

The Service allows you to create and manage detailed window and door drawings. Drawings may contain:

• Frame dimensions
• Frame shapes
• Light divisions
• Mullions
• Sashes
• Opening configurations
• Glass specifications
• Panels
• Screens
• Hardware
• Hinges
• Grille and bar patterns
• Frame colours and finishes
• Annotations
• Guidelines
• Notes
• Other design and measurement information entered or created by the user

You are responsible for reviewing drawings and measurements before relying on them for manufacturing, fabrication, installation, quotation, ordering, or other purposes.

The Service does not independently verify whether a drawing, measurement, configuration, material selection, or other technical information is suitable for a particular manufacturing or installation requirement.

6. Measurements and Technical Information

The Service provides tools for entering and working with measurements, dimensions, areas, quantities, and other technical information.

The application performs validation and calculations based on the information and configurations available within the application.

However, the Service does not guarantee that every calculation, measurement, configuration, drawing, area, quantity, or other technical result will be suitable for every manufacturing or installation situation.

Users are responsible for independently verifying important measurements, dimensions, specifications, material requirements, structural requirements, fabrication requirements, installation requirements, and other technical information before using them in real-world work.

The Service should not be considered a substitute for professional engineering, architectural, fabrication, construction, surveying, or installation advice.

7. 3D Preview

The Service may provide a 3D preview of a drawing.

The 3D preview is intended to help users visually understand the configuration and appearance of a frame.

The 3D preview should not be treated as a guarantee of the final manufactured product, exact physical appearance, structural performance, installation conditions, or manufacturing outcome.

Users remain responsible for verifying the underlying dimensions, materials, configurations, and technical requirements.

8. User Content

You may enter, create, edit, save, or otherwise provide customer, order, drawing, measurement, configuration, profile, notes, and other information through the Service ("User Content").

You retain ownership of the User Content you provide.

By submitting User Content, you grant us the limited rights necessary to:

• Store your information
• Process your information
• Display your information to you
• Maintain your orders and drawings
• Provide drawing and design functionality
• Provide measurement and calculation functionality
• Provide 3D preview functionality
• Synchronize applicable information
• Maintain and operate the Service
• Maintain the security and functionality of the Service

We do not claim ownership of your User Content solely because you use the Service.

9. Acceptable Use

You agree not to use the Service to:

• Violate applicable laws or regulations
• Provide information that you do not have the right or permission to use
• Intentionally provide false or misleading information
• Attempt to gain unauthorized access to the Service
• Access another user's information
• Interfere with or damage the Service
• Upload malicious software or harmful code where uploads are supported
• Attempt to compromise the security of the Service
• Reverse engineer or attempt to extract source code from the Service except where permitted by applicable law
• Abuse or misuse the Service
• Circumvent technical restrictions or usage limitations
• Use the Service for unlawful or fraudulent purposes

We may restrict or terminate access where reasonably necessary to protect the Service, users, third parties, or comply with applicable law.

10. Offline Storage and Synchronization

The Service is designed as an offline-first application.

Supported drawings, orders, and other application information may be stored on your device and remain available when you do not have an active internet connection.

Changes made while offline may be placed in a synchronization queue and transmitted when network connectivity becomes available.

The Service does not guarantee that synchronization will occur immediately or successfully in every circumstance. Synchronization may be delayed or interrupted by:

• Lack of network connectivity
• Server availability
• Authentication issues
• Device restrictions
• Technical failures
• Maintenance
• Other circumstances outside our reasonable control

Users are responsible for ensuring that important work has synchronized successfully when required.

11. Data Storage

The Service stores certain information locally on your device to support its offline-first functionality. Local information may include:

• Orders
• Drawings
• Profile information
• Synchronization information
• Other information required to operate the application

The Service may also transmit applicable information to backend services for account management and synchronization.

Deleting or modifying information while offline may result in a synchronization operation being performed later when connectivity becomes available.

12. Third-Party Services

The Service may rely on third-party services or infrastructure to provide certain technical functionality, including services related to:

• Cloud infrastructure
• Data storage
• Database infrastructure

Third-party services may have their own terms and privacy policies. Your use of certain third-party services may therefore be subject to their applicable terms and policies.

We are not responsible for the availability, accuracy, policies, security, or performance of third-party services that are outside our reasonable control.

The Service, including its software, interface, design, branding, logos, text, graphics, original icons, drawing tools, and other materials provided by us, is owned by or licensed to Equitysoft Technologies Pvt. Ltd. and is protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, lease, reverse engineer, or otherwise exploit our proprietary materials.

Your User Content remains yours, subject to the rights granted to us under these Terms.

14. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, store, share, and protect information.

By using the Service, you acknowledge that you have reviewed our Privacy Policy.

15. Service Availability

We aim to keep the Service available and functional, but we do not guarantee that it will always be:

• Available
• Uninterrupted
• Error-free
• Secure
• Compatible with every device
• Free from technical issues
• Able to synchronize information without interruption
• Able to calculate or display every drawing or configuration without errors
• Able to preserve every synchronization operation without delay

The Service may occasionally be unavailable because of maintenance, updates, technical issues, database issues, authentication service interruptions, third-party service interruptions, connectivity problems, or other circumstances.

16. Updates

We may release updates to improve the Service's functionality, security, compatibility, or performance.

You may need to install updates to continue using certain features of the Service. Features may be added, modified, or removed as the Service develops.

Changes to the application's drawing tools, supported configurations, calculations, storage, synchronization, or other functionality may occur through application updates.

17. Account Suspension or Termination

You may stop using the Service at any time and may request deletion of your account.

We may suspend or terminate an account if:

• You violate these Terms
• You misuse the Service
• You engage in fraudulent or unlawful activity
• Your actions create a security or legal risk
• You attempt to access another user's information
• You provide prohibited or harmful content
• We are required to do so by law

Where appropriate and reasonably possible, we may provide notice before taking such action.

18. Design, Calculation and Fabrication Disclaimer

Aluminium Window Design 3D is intended as a design, measurement, drawing, visualization, and work organization tool. The Service does not provide professional engineering, architectural, structural, fabrication, construction, surveying, or installation advice.

We do not guarantee that:

• A drawing is suitable for a particular manufacturing process
• A measurement is correct for a specific installation
• A frame configuration meets applicable building or safety requirements
• A selected material or component is suitable for a particular project
• A calculated area or quantity is suitable for procurement
• A quotation or job total represents the actual final project cost
• A 3D preview exactly represents the final manufactured product
• A drawing contains every requirement necessary for fabrication or installation
• Information entered by the user is complete or accurate
• The Service will identify every possible design or configuration issue

Users should verify important drawings, dimensions, specifications, materials, fabrication requirements, installation requirements, local regulations, and other technical requirements with appropriately qualified professionals where necessary.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Equitysoft Technologies Pvt. Ltd. will not be responsible for indirect, incidental, special, consequential, or similar damages arising from your use of or inability to use the Service.

This may include, to the extent permitted by applicable law, losses or damages resulting from:

• Incorrect customer or order information
• Incorrect measurements
• Incorrect dimensions
• Incorrect calculations
• Incorrect drawing configurations
• Manufacturing or fabrication errors
• Installation errors
• Material selection errors
• Incorrect quotations or job totals
• Reliance on 3D previews
• Loss or unavailability of stored information
• Failed or delayed synchronization
• Service interruptions
• Device failures
• Third-party service failures
• Unauthorized access resulting from circumstances outside our reasonable control

Nothing in these Terms limits liability that cannot legally be excluded under applicable law.

20. Account & Data Deletion

You may request deletion of your account and associated information.

You may also request deletion of saved orders, drawings, profile information, and other information associated with your account.

Deleting a drawing or order from the application removes the applicable local record. If that information has already been synchronized with our backend services, the deletion may also be processed as a synchronization operation.

Because the Service supports offline work, a deletion performed while offline may remain pending until synchronization becomes available.

Upon receiving a deletion request, we will take reasonable steps to process the request in accordance with our Privacy Policy and applicable legal requirements.

Certain information may be retained where required for legal, security, fraud prevention, dispute resolution, or compliance purposes.

21. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the Last Updated date above.

Your continued use of the Service after updated Terms become effective means that you accept the updated Terms, to the extent permitted by applicable law.

22. Governing Law

These Terms will be governed by the laws of India, without regard to conflict-of-law principles, unless applicable law requires otherwise.

Any disputes will be handled by the courts or dispute-resolution mechanisms having appropriate jurisdiction over the matter.
